LIMITED CUSTOMER WARRANTY

This limited warranty gives you specific legal rights and you may also have other rights, which vary from state to state.

We warrant that during the warranty period, the product will be free from defects in materials and workmanship.

We limit the duration and remedies of all implied warranties, including without limitation the warranties of merchantability and fitness for a particular purpose to the duration of this express limited warranty.

Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Our responsibility for defective goods is limited to repair, replacement, or refund as described below in this warranty statement.

WHO MAY USE THIS WARRANTY?
GProducts LLC d/b/a VARIA FITNESS^®, located at 546 Hoptree Ct. Louisville CO 80027 or an authorized distributor of VARIA FITNESS^® products ("we") extend this limited warranty only to the consumer who originally purchased the product ("you"). It does not extend to any subsequent owner or other transferee of the product.

IF YOU PURCHASED ANY VARIA FITNESS PRODUCT FROM A THIRD-PARTY SELLER OR DISTRIBUTOR, THIS WARRANTY IS NOT APPLICABLE TO YOU UNLESS THE SELLER OR DISTRIBUTOR EXPRESSLY STATED (EITHER IN THE APPLICABLE PRODUCT LISTING OR A PURCHASE AGREEMENT) THAT THIS WARRANTY APPLIES TO YOU. THE SELLER OR DISTRIBUTOR FROM WHOM YOU PURCHASED THE PRODUCT MAY OFFER ITS OWN WARRANTY. PLEASE CONTACT THE SELLER OR DISTRIBUTOR TO LEARN MORE.

WHAT DOES THIS WARRANTY COVER?
This limited warranty covers defects in materials and workmanship of the VARIABELL^® and VARIABALL^® (the "product") for the Warranty Period as defined below.

WHAT DOES THIS WARRANTY NOT COVER?
Dropping the VARIABELL^® adjustable weight kettlebell VOIDS the warranty.

In addition, this limited warranty does not cover any damage due to: (a) failure to follow the product instructions; (b) negligent, faulty, or improper use; (c) storage; (d) failure to perform any preventive maintenance; (e) modifications; (f) unauthorized repair; (g) normal wear and tear; (h) transportation; or (i) external causes such as accidents, abuse, or other actions or events beyond our reasonable control.

WHAT IS THE PERIOD OF COVERAGE?
This limited warranty starts on the date of your purchase and lasts for ONE YEAR (the "Warranty Period"). The Warranty Period is not extended if we repair or replace the product. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?
With respect to any defective product during the Warranty Period, we will, in our sole discretion, either: (a) repair or replace such product (or the defective part) free of charge or (b) refund the purchase price of such product. We will also pay for shipping and handling fees to return the repaired or replacement product to you if we elect to repair or replace the defective product.

HOW DO YOU OBTAIN WARRANTY SERVICE?
To obtain warranty service, contact the company you originally purchased your VARIA FITNESS^® product from. If you purchased your product directly from VARIA FITNESS^®, email our Customer Service Department at SUPPORT@VARIAFITNESS.COM during the Warranty Period to notify us of the defect. We will endeavor to respond to your email within 5 business days. We may require that you submit additional information and/or ship the product back to us in order to verify your claim.

LIMITATION OF LIABILITY
The remedies described above are your sole and exclusive remedies and our entire liability for any breach of this limited warranty. Our liability shall under no circumstances exceed the actual amount paid by you for the defective product, nor shall we under any circumstances be liable for any consequential, incidental, special or punitive damages or losses, whether direct or indirect.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

RETURNS AND REFUNDS

Returns
We have a 30-day return policy. If 30 days have gone by since your purchase was delivered, unfortunately we are unable to offer you a refund or exchange. For any returns within 30 days, customer is responsible for paying the shipping costs for returning your item and a 10% restocking fee.

To be eligible for a warranty return, we require a receipt or proof of purchase; and your item must be in the original packaging, unused, and in the same condition that you received it.

There are certain situations where only partial refunds are granted (if applicable).

Any item not in its original condition, damaged, or missing parts for reasons not due to our error are not eligible for return.

Refunds
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item and whether the return is approved or rejected.

If your return is approved, we will process your return within a week of receiving the returned product and a credit will automatically be applied to your credit card or original method of payment.
